Copyright Infringement & DMCA Notice
Effective date: October 12, 2026
If you believe material available through mtnduck.com infringes your copyright, you may send a notice of claimed infringement to our designated agent. This process follows the notice requirements in 17 U.S.C. § 512(c)(3).
Where to send a notice
Designated agent: Hardball HQ LLC
Email: mtnDuck@HardballHQ.com
Mailing address: available upon request
Telephone: (513) 525-1460
What to include in your notice
A complete notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work you claim has been infringed. If the notice covers multiple works at one location, provide a representative list of those works.
- Identification of the material you claim is infringing and information reasonably sufficient to help us locate it, such as the page URL.
- Your name, mailing address, telephone number, and email address, if available.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, the owner's agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
After receiving a notice, we may remove or disable access to material that we believe is infringing, contact the person who provided it, or take other appropriate action. We may also provide the notice to the person responsible for the material. A knowingly false or materially misleading notice may have legal consequences.
Counter-notices
If material you provided was removed or disabled because of a copyright notice, and you believe it was removed as a result of mistake or misidentification, you may send a counter-notice to our designated agent.
A counter-notice should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and where it appeared before removal or disablement.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located. If your address is outside the United States, state that you consent to the jurisdiction of any judicial district in which the service provider may be found. You must also agree to accept service of process from the person who submitted the original notice or that person's agent.
We may forward a counter-notice to the person who submitted the original notice. Under the DMCA process, we may restore the material 10 to 14 business days after receiving a valid counter-notice unless our designated agent first receives notice that the original complainant has filed a court action seeking to restrain the allegedly infringing activity.
